1. PARTIES AND DEFINITIONS

  • Service Provider: WISECP LLC.
  • Customer: The natural or legal person purchasing services from the Service Provider.
  • Service: All digital services provided to the Customer, including hosting, server hosting, domain services, and related services.

2. SUBJECT OF THE AGREEMENT

This agreement regulates the mutual rights and obligations regarding the hosting services purchased by the Customer. By completing the service selection and purchase process through the online platform, the Customer is deemed to have accepted all terms of this agreement.

3. SERVICE PRINCIPLES

3.1. Scope of Service

  • All services within the hosting package selected by the Customer
  • Web space, email, database, and other technical features according to the selected package
  • Technical support services
  • Control panel access

3.2. Service Quality

  • Service Provider maintains the necessary technical infrastructure for uninterrupted server operation
  • Required security measures are implemented
  • Technical support is provided through designated channels

4. RESPONSIBILITIES OF THE PARTIES

4.1. Service Provider's Responsibilities

  • Taking necessary measures to provide uninterrupted services
  • Maintaining and securing technical infrastructure
  • Protecting Customer data confidentiality
  • Providing regular backup service

4.2. Customer's Responsibilities

  • Ensuring security of account information and passwords
  • Using legally compliant content
  • Preventing system resource abuse
  • Making timely payments
  • Maintaining regular backups of their data

5. FINANCIAL TERMS

5.1. Payment

  • Service fee is collected based on the current price of the selected package
  • Payments are processed through the online payment system
  • Service renewal payments can be automated

5.2. Price Changes

  • Service Provider reserves the right to update prices according to market conditions
  • Price changes will be notified to existing customers at least 15 days in advance

6. SERVICE RESTRICTIONS AND USAGE RULES

6.1. Prohibited Uses

  • Content-Related Prohibitions:
  • Any illegal content
  • Materials violating copyright or intellectual property rights
  • Pornographic, obscene, or adult-oriented content
  • Materials containing violence, hate speech, or discrimination
  • Gambling and betting content
  • Counterfeit product sales or fraudulent sites
  • Malware, viruses, or malicious code
  • Drug, weapon, or illegal substance sales
  • Unlicensed software distribution
  • Content violating personal rights
  • Materials disclosing state secrets
  • Terrorist propaganda materials
  • System Usage Prohibitions:
  • Spam or mass unsolicited email distribution
  • Email bombing or mail server abuse
  • DDoS attacks or other cyber attack attempts
  • Using server resources for cryptocurrency mining
  • Creating botnet or zombie networks
  • Brute force attacks
  • Port scanning and vulnerability searching
  • IP spoofing or packet manipulation
  • Phishing sites
  • Providing proxy or VPN services
  • Running IRC servers or bots
  • Hosting trojans, keyloggers, or RATs
  • Traffic and Resource Usage Prohibitions:
  • Excessive CPU usage (above package limits)
  • Excessive RAM consumption
  • Disk I/O resource abuse
  • Network bandwidth abuse
  • Use as a file sharing service
  • Use as a free file hosting service
  • Use as streaming media server (unless permitted)
  • Running scripts requiring constant high CPU usage
  • Creating constantly running background processes
  • Excessive simultaneous database connections
  • SEO and Indexing Prohibitions:
  • Creating link farms
  • Doorway pages
  • Spam blogs (splogs)
  • Automated content generation and scraped content
  • Generating fake traffic
  • Search engine manipulation
  • Creating unwanted backlinks
  • Content copying and duplication
  • Generating fake social media engagement

6.2. Resource Usage

  • CPU, RAM, and disk usage are limited within fair usage policy
  • Service may be temporarily suspended in case of excessive resource usage
  • Service Provider may modify resource usage limits when necessary

7. PRIVACY AND DATA SECURITY

7.1. Data Protection

  • Customer information is kept confidential and not shared with third parties
  • Personal data is processed and protected under applicable data protection laws
  • Service Provider does not share customer data except for legal requirements

7.2. Backup Policy

  • Regular data backup is primarily the Customer's responsibility
  • Service Provider performs weekly backups, but these are not guaranteed and are provided only as an additional security measure
  • Customer is obligated to maintain regular backups of their data
  • Backups taken by Service Provider do not constitute a guarantee for compensation or recovery in case of data loss
  • Customers are recommended to create their own backup solution and maintain regular offline backups for critical data
  • Service Provider is not responsible for backups being incomplete, faulty, or unusable
  • Service Provider bears no responsibility in case backup service cannot be provided

8. SERVICE CHANGES AND TERMINATION

8.1. Service Changes

  • Package features may be updated
  • Technical infrastructure changes may be made
  • Changes will be communicated to Customer in advance

8.2. Agreement Termination

  • Customer may terminate service at any time
  • Service Provider may terminate service in case of rule violations
  • Service will be suspended or terminated in case of non-payment
  • Service may be terminated immediately if prohibited usage is detected

9. FORCE MAJEURE

Natural disasters, war, terrorism, cyber attacks, internet infrastructure problems, and other circumstances beyond control are considered force majeure, and Service Provider cannot be held responsible for these situations.

10. DISPUTE RESOLUTION

Disputes shall be resolved primarily through mutual negotiation. In case of disagreement, courts of [Turkey / Ankara] shall have jurisdiction.

11. EFFECTIVENESS

This agreement becomes effective upon Customer's purchase of service through the online platform and remains valid until service termination.

12. UPDATES

Service Provider may update this agreement. Updates will be published on the website and communicated to Customer. Customer's continued use of the service indicates acceptance of updated terms.

13. OTHER PROVISIONS

  • For matters not specified in this agreement, applicable commercial code, obligations law, and relevant legislation shall apply.
  •  Invalidity of any provision does not affect the validity of other provisions.
  • This agreement is accepted electronically(online) via service purchase stage.
